These Terms of Service govern your use of the website located at https://getmorsel.com, the Morsel recipe app at https://recipes.getmorsel.com, and any related services provided by Wilbur LLC / Morsel.

By accessing https://getmorsel.com, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by Wilbur LLC / Morsel.

We, Wilbur LLC / Morsel, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

Intellectual Property

The license you grant us can be terminated at any time by deleting your content or account. Recipes and Other Content You Add

The Morsel recipe app lets you add recipes by typing them in, by scanning photos of recipe cards or pages (Recipe Card Scan), and by pasting a link to a recipe on another website. However you add a recipe, it is your content, and you are solely responsible for it.

When you add, import, scan, upload, save, share, or print any recipe, photo, text, audio, or other material (“your content”), you represent and warrant that:

  1. you own your content, or you have the rights, licenses, and permissions needed to use it the way you use it in Morsel, including sharing it with your groups and including it in printed cookbooks;
  2. your content, and your use of it, does not infringe or violate anyone’s copyright, trademark, privacy, or other rights; and
  3. you will follow the terms of use of any website, book, or other source that you take recipes from.

When you save a recipe from a link, Morsel reads that web page at your request and fills in the recipe’s name, ingredients, steps, and servings for you to check. Morsel does not copy the website’s photos or its description, and it adds a credit and a link to the original page. Morsel does not review, approve, or endorse recipes you add, and does not decide whether you have the right to use them. Recipes saved from other sources are meant for your personal and family use. Please only save recipes you have the right to use, keep the credit to the original creator, and write descriptions and take photos of your own.

Recipes filled in by Recipe Card Scan or from a link are read automatically, with the help of artificial intelligence, and may contain mistakes. You are responsible for checking every recipe, including quantities, temperatures, cooking times, and ingredients and allergens, before you save, cook, share, or print it.

Indemnity

You agree to indemnify, defend, and hold harmless Wilbur LLC / Morsel and its owners, employees, contractors, and suppliers from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your content, your use of Morsel, or your breach of these Terms of Service, including any claim that your content infringes or violates someone else’s rights.

Copyright Complaints

We respect the work of recipe creators. If you believe that content in Morsel infringes your copyright, please email ian@getmorsel.com with:

  1. your name and contact details;
  2. a description of the copyrighted work;
  3. where the content appears in Morsel (for example, a link or the recipe’s name);
  4. a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law;
  5. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner; and
  6. your physical or electronic signature.

We may remove or disable access to the content, let the person who added it know, and suspend or close the accounts of people who repeatedly infringe others’ rights.

Liability

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, Wilbur LLC / Morsel makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Wilbur LLC / Morsel or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Wilbur LLC / Morsel or an authorized representative has been notified, orally or in writing, of the possibility of such damage.
